Remodeling (“Sunshine,” “us,” or “we”) to you (“Client,” “you,” or “your”). Please read these Terms carefully before you agree to them. By using our services, you agree to be bound by these Terms.
1. Services
Sunshine provides a variety of home remodeling services. A detailed description of the services included in your project will be outlined in a separate written contract (the “Contract”).
2. Contract
The Contract will supersede these Terms in the event of any conflict. The Contract will detail the specific scope of work, project timeline, payment schedule, and any additional terms specific to your project.
3. Project Changes
Any changes to the scope of work outlined in the Contract must be agreed upon in writing by both Sunshine and the Client. Additional costs associated with project changes will be outlined in a written change order amendment to the Contract.
4. Payments
Payment terms will be outlined in the Contract. Sunshine typically requires a deposit upfront, with progress payments due throughout the project. Sunshine reserves the right to withhold work if payment is not received according to the agreed-upon schedule.
5. Schedule
Sunshine will provide an estimated project timeline in the Contract. This timeline is subject to change due to unforeseen circumstances, including material availability, weather delays, or permit approvals. Sunshine will keep you informed of any schedule changes.
6. Permits and Inspections
Sunshine is responsible for obtaining any necessary permits for your project. The Client is responsible for ensuring their property is accessible for inspections by relevant authorities.
7. Warranties
Sunshine warrants the quality of our workmanship for a period of one (1) year from the completion of the project. This warranty covers defects in materials and installation performed by Sunshine. Warranties on materials will be determined by the manufacturer.
8. Limitation of Liability
Sunshine will not be liable for any incidental, consequential, or indirect damages arising from our services. Our liability is limited to the total cost of the project.
9. Termination
This Agreement may be terminated by either party upon written notice for breach of these Terms or the Contract. In the event of termination, Sunshine will be entitled to compensation for all work completed up to the date of termination.
10. Governing Law
These Terms and Conditions will be governed by and construed in accordance with the laws of the State of [State where Sunshine Remodeling is located].
11. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Contract will be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be held in [City, State where Sunshine Remodeling is located].

These Terms and the Contract constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
14. Waiver
No waiver by Sunshine of any breach of these Terms will be deemed a waiver of any subsequent breach.

All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, sent by certified or registered mail, return receipt requested, or sent by overnight courier to the addresses set forth below:
